Misty Hataway-Coné is no stranger to challenging litigation.

And if given the opportunity to work on complex litigation 24/7 — she’d be ecstatic to take on the hard cases…

that most attorneys wouldn’t want to touch.

Misty’s love for a challenge comes naturally and began decades ago when she first started her undergraduate studies at Texas A&M University in College Station. 

Driven by a duty to serve, she began as a biomedical science major with hopes of attending medical school. But one year later, Misty followed her calling as she changed majors to political science and speech communication with plans to attend law school. Always striving to see both sides to an argument, Misty became heavily involved in both Aggie Democrats and College Republicans, working on local campaigns in the Brazos County area and throughout Texas. She also became involved in the Texas A&M Pre-Law Society which further exposed Misty to the future that would lie ahead.

After completing her undergraduate studies, Misty returned to Houston, where she attended and excelled at the nationally ranked advocacy program at South Texas College of Law-Houston.

During her time in law school, Misty succeeded both in the classroom and in the courtroom. During her three years at STCL-Houston, Misty earned Dean’s List recognition multiple times as well as appointment to the Order of the Lytae and Order of the Barristers.  She was involved in the South Texas College of Law Law Review and served as Assistant Managing Editor her 3L year.  She also led the Board of Advocates as Chairman of the program.  Misty also enjoyed competing as a Varsity advocate, traveling throughout the United States competing in regional and national moot court competitions.  Misty and her teammates won a National Championship in 2000 at the Evan A. Evans National Constitutional Law Moot Court tournament at the University of Wisconsin.  There she was recognized as Best Advocate in the tournament and Best Brief.

After graduating law school, Misty embarked on new adventures in Dallas, Texas, as she began working for a national defense firm.

Misty continued practicing law at “big firms” until 2016, when she left “big law” and began working on her own.  Always striving to serve others and to make a difference, Misty began working for smaller businesses, individuals, and other law firms, utilizing her unique skill set to resolve the toughest of litigation matters.

Since embarking on her own, Misty’s commitment to service continues. 

In her free time, she proudly serves the Greater Houston community with her involvement in her local Rotary Club and two separate Chamber of Commerce organizations.  Misty regularly donates her free time to the local soccer programs and booster Clubs, various sections of the State Bar, and HBA initiatives including Lawyers for Literacy.  Misty also serves on the Board of the Alumni Association at South Texas College of Law-Houston.  Misty is also a proud member of the Houston Trial Lawyers Association and Texas Trial Lawyers Association. For the last three years she has also worked as an adjunct professor at Thurgood Marshall School of Law teaching appellate litigation.

Professionally, Misty’s successes and commitment to client-driven service has been repeatedly recognized.

From 2009 to 2016, she was recognized by Thomson Reuters as a Texas Rising Star in appellate litigation–an honor bestowed upon only the top 2.5% of lawyers selected through a peer evaluation “blue ribbon” review.

Since 2016, she has been selected by Thomson Reuters as a Texas Super Lawyer in appellate litigation–an award given to no more than 5% of the lawyers in the state selected by the research team at Super Lawyers.

Misty has also been recognized by H Texas Magazine as a “Houston Top Lawyer” from 2012-2016 and again in 2019. Houstonia Magazine recognized Misty as a “Top Lawyer in Houston” in 2015.

Misty is also a proud wife and mother. 


Her family is her motivation to go beyond the call of duty to help her clients. 


Her home has been the gymnasium for her to exercise her love for different personalities and to strengthen her ability to understand different approaches to seemingly familiar problems. She is a wife to Paul; a mom to Emma, Christian, and Alex; and the daughter of Warren and Annette Hataway, all of whom have had an indelible impact on her life.

By the time her daughter begins practicing law, Misty hopes that the legal field will look more like the real world…

As a woman who has had to cut her teeth to move through the ranks of some of the largest, most in-demand law firms in the country, Misty thoroughly understands the plight of women. Her highest priority is to produce phenomenal work that exemplifies brilliance and reframes the conversations concerning the intellectual and emotional capacity that women attorneys have. By the time her daughter begins practicing law, Misty hopes that the legal field will look more like the real world: filled with people of different backgrounds, experiences, genders/pronouns, and nationalities, who are respected and honored for their talents and skills.
